I lost my job a year ago when I divorced my husband...long story...then 3 months ago i got in a terrible car accident, broke my back, my ribs, my nose, and crushed my ankle. I could not work during this time. and i did not apply for disability as I have NEVER collected any monies from federal programs. Now, I have $85,000 in hospital and medical bills and it is going to force me to declare bankru[tcy. HOW do I do this? DO I have to use an attorney? If not...where do I go for info?? Then I saw this white car in front of me, who stepped on his brakes, and as soon as I saw that, I stepped on mines. False County Court Claim Against Me on My Car Insurance?

Someone has put a claim in against me for damages, for an accident I know nothing about. It is from early 2010 and has been going on since then. I have been contesting it on the grounds I have not been involved in an incident, however the third party solicitors have issued County Court proceedings against me. My insurance company are saying they are putting in a defence and have provided a barrister. I am really annoyed with this as I know I haven't been in an accident. I could understand if maybe they were claiming I clipped them and I had done it without realising but they are claiming for an accident which I have no knowledge of! I have attended the Magistrate's Court hearing and although I pleaded not guilty I have been found guilty on the grounds that for the time and date of the accident I have no alibi, witness or other evidence to support my whereabouts. The other party has an independent witness who works for the same company and alleges she could recognise my car but not me as a driver. Mag court fined me and gave me 6 points on my licence. I am not working (and not in receipt of any benefits) and this CC claim amounts to 5k! How would I pay a sum like this??? Or would my insurance company pay out if I was found to be at fault ??? Not at fault in car accident, but insurance says I am?

I was involved in an accident in 2011. I was going straight past an intersection and another truck going the opposite direction turned at the intersection, striking me. He admitted he did not see me and was clearly at fault. I filled out the police report and it states, by both parties, that he was at fault. A year later I bought a new car. I tried to get insurance. Everywhere I go my quotes are sky high, like almost $200 a month. I asked them why so much, and they advised I was listed at fault in the accident. I called the DMV, the insurance adjuster, and the police, and they all say I am not at fault. Well, the DMV says they see an accident but it does not show who was at fault. The insurance companies keep saying they are getting this info from the DMV but thats not possible. I was told by one small insurance company that this is a tactic used by companies. They see me as not at fault but try to manipulate me to get more money. What do I do to clear my name? I have the official police report, as well as all my medical bills from the accident. Again, the DMV cannot see any at fault, therefore cannot do or change anything.

Back in October of 2010I was involved in a Hit and Run Accident. The Guy that hit us was found a few days later and we filed against his insurance. Me and my Fiance both went through Physical therapy for our backs. Medical bills totalled about 5K for me and about 8K for her. There were times when she was in tears because her back was hurting so bad. She Couldnt work some days either and she is self employed and works from home as a graphic Designer. I missed some days of work too but my pain was not near as much as hers. State Farm Called and offered a settlement with me to pay the 5k to the Doctor and then a $1000 check to me for my pain and suffering. They called my Fiance to settle but she did not answer. My guess is they will probably offer her the same. Is Paid medical bills plus $1,000 fair? We missed work from it. Delt with stress and Physical therapy for about 3 months and not to mention all of the inconveniences associated with getting the car fixed and also dealing with insurance stuff. The guy that hit us was found a few days later but never offered a good excuse as to why he hit us and then ran. He originally filed a false claim with State Farm and said that he hit a tree and not another vehicle. It was all overturned against him once Geico called them and submitted the police report. after a claim with my car insurance they wanted the policy payment in full,i would;nt pay it at first because of the crap service i recieved.4 weeks later i said i would pay as long as my policy ran its term they refused but still want the policy money.now they wont release my no claims bonus until i give them the money. what can i do ?

Lots of info, sorry! My car was parked on the street and hit during the night. I drove the car to the repair place the following morning and the airbag deployed on the way there. (Stupid, I know, I wasn't thinking). My insurance company, GEICO is insisting that the damage is not consistent with a hit and run accident. They have taken recorded statements from me and my boyfriend. They have contracted an independent accident reconstructionist to read the airbag deployment. The reconstructionist originally told me that he was unable to retrieve the data, but the insurance company is now telling me that he was able to get a partial reading. And that it shows that the airbag deployed as a result of impact. The airbag did not actually fully deploy. There is no powder or injury to me to justify a complete deployment. Does anybody know if they have the right to deny my claim based on suspicion? They keep trying to make me say that my boyfriend was driving the car, which he wasn't. We were in the house together all night. Also: car was in previous fire; severe damage to front of car, all repaired. accident happened in CA, full coverage policy written in GA I know its a lot of info. Should I file a claim with my car insurance or pay out of pocket?

I am making payments on my car and currently have full coverage car insurance. About a week ago, I was driving my car on the freeway. It had been raining earlier that morning. A car beside me switched lanes in front of me suddenly. (She did not hit my car) but she caused me to loose control, my car hydroplaned spun out and hit the center divder on the freeway. No other cars hit me. My car has damage to the tire, rim and the right rear of my car from the back door to the bumper has scrathes and damage. I did not file a claim at first because the cost of my insurance is already $108 (because of a ticket) and I did not want it tod go up. But after paying to replace the tire, the rim and some other issues with the axile for $606....and the tow service which was $125; I'd like to know if any one has an idea of which would be more beneficial. Should I pay the $1000 deductible and have my car fixed through the insurance company, even though my monthly payments will increase? Or should I just continue the repairs out of pocket?
